Welcome to Lofic ("the App," "we," "our," or "us"). These Terms of Use ("Terms") govern your use of our mobile application and services. By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using Lofic, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These Terms constitute a legally binding agreement between you and the App.

2. Subscription Services

2.1 Subscription Plans

The App offers the following premium plans:

Weekly Subscription: $4.99 per week (20 AI generations per week, auto-renewable)
Annual Subscription: $49.99 per year (200 AI generations per year, auto-renewable)
Lifetime: $49.99 one-time purchase (200 AI generations per year, no recurring charges)

2.2 Premium Features

Ad-free experience - Enjoy uninterrupted AI music generation
AI Music Generation - Usage limits depend on your plan (see 2.1)
Faster processing - Priority queue for music generation
Enhanced audio quality - High-quality audio output
Priority customer support

2.3 Lifetime Purchase

The Lifetime plan is a one-time, non-consumable purchase that grants permanent access to premium features:

No recurring charges or auto-renewal
200 AI generations per year (resets annually from purchase date)
All premium features included
Can be restored on any device using the same Apple ID

2.4 Billing and Auto-Renewal (Subscriptions Only)

For Weekly and Annual subscriptions:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscription automatically renews unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
The cost of renewal will be the same as your initial subscription price unless we notify you of pricing changes

Note: The Lifetime plan is a one-time purchase and does not auto-renew.

2.5 Managing Your Subscription

You can manage or cancel your subscription through your Apple ID Account Settings:

Go to Settings on your iOS device
Tap your name at the top
Tap Subscriptions
Select Lofic
Choose to modify or cancel your subscription

2.6 Free Trial

We may offer a free trial period for subscription plans. If you don't cancel before the trial ends, you will be automatically charged for the subscription. Free trials do not apply to Lifetime purchases.

3. Use License

3.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal devices for personal, non-commercial use, subject to these Terms.

3.2 License Restrictions

You agree not to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Sell, rent, lease, sublicense, or distribute the App
Use the App for illegal or unauthorized purposes
Violate any applicable laws or regulations
Attempt to gain unauthorized access to our systems
Use automated systems to access the App

4. User Content and Conduct

4.1 Your Creations

You retain rights to your creative inputs (prompts and preferences). The AI-generated music is provided for your personal use according to these Terms.

4.2 Acceptable Use

You agree to use the App responsibly and not to:

Generate content that infringes on intellectual property rights
Create offensive, harmful, or inappropriate content
Use the App to harass, abuse, or harm others
Interfere with or disrupt the App's operation
Attempt to bypass any technical limitations
Use generated content for commercial purposes without proper licensing

5. Intellectual Property Rights

5.1 App Ownership

The App and its original content, features, and functionality are and will remain the exclusive property of Lofic and its licensors. The App is protected by copyright, trademark, and other intellectual property laws.

5.2 Generated Content

AI-generated music created through the App:

Is provided for personal, non-commercial use
May not be unique or exclusive to you
Should be used in compliance with all applicable laws
May require additional licensing for commercial use

6. Third-Party Services

The App integrates with third-party services for functionality:

Replicate API for AI music generation
Cloudflare AI for enhanced processing capabilities
Apple services for app distribution and payments
Google AdMob for advertisement services (free tier)

Your use of these services is subject to their respective terms and policies.

7. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your information.

8. Disclaimers and Limitations

8.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee

We do not guarantee that:

The App will be uninterrupted or error-free
AI-generated content will meet your expectations
Generated music will be unique or original
The App will be free from security vulnerabilities

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.

9. Indemnification

You agree to indemnify and hold harmless Lofic, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

10.1 Your Right to Terminate

You may stop using the App at any time by deleting it from your device and canceling any active subscriptions.

10.2 Our Right to Terminate

We may suspend or terminate your access to the App immediately if you breach these Terms or for any other reason at our discretion.

10.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination will remain in effect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the App or other means. Continued use after changes indicates acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. You agree to submit to the jurisdiction of courts in California.

13. Dispute Resolution

13.1 Informal Resolution

Before formal proceedings, you agree to attempt informal dispute resolution by contacting us at support@lofic.app.

13.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. General Provisions

14.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Lofic.

14.2 Severability

If any provision is found invalid, the remaining provisions continue in full force.

14.3 No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

14.4 Assignment

You may not assign these Terms without our consent. We may assign our rights without restriction.

15. Refund Policy

All purchases, including subscriptions and the Lifetime plan, are final and non-refundable, except as required by law. The Lifetime plan is a permanent, one-time purchase and cannot be refunded once the transaction is complete. Refund requests should be directed to Apple through your Apple ID account.

These Terms are between you and Lofic only, not Apple
Apple has no obligation to provide maintenance or support
Apple is not responsible for addressing any claims about the App
Apple is not liable for any third-party intellectual property claims
Apple and its subsidiaries are third-party beneficiaries of these Terms
